Who We Are

LotCheck Pty Ltd (ACN 692 936 502) (“LotCheck”, “we”, “our”, “us”) owns and operates the LotCheck platform, a property technology tool embedded into land estate developer websites that helps buyers visualise builder floor plans on specific lots and submit enquiries.

This Privacy Policy explains how we collect, use, store and disclose personal information when you interact with our platform, website, or contact us directly.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), including the Privacy and Other Legislation Amendment Act 2024 (Cth).

•       Professional details: company name, role, and project details (relevant to estate developers, builders, and industry contacts).

•       Property and project preferences: estate selection, lot preferences, floor plan interests, and related enquiry details.

•       Communications: any information you provide through contact forms, emails, or direct correspondence.

•       Technical and usage data: IP address, browser type, device details, pages visited, and cookies or analytics data collected when you use our website.

•       Consent records: your preferences for receiving marketing or follow-up communications.

We only collect information that is reasonably necessary for our functions or activities.

We collect personal information directly from you when you:

•       Submit an enquiry or contact form on our website or platform.

•       Interact with the LotCheck platform embedded on an estate developer’s website.

•       Attend events or meetings where you provide us with your details.

We may also receive information indirectly from estate developers or builders who use our platform in connection with a project you are involved in.

You can choose not to provide your information, but if you do, we may be unable to respond to your enquiry or provide access to the platform.

4.  How We Use Your Information

We collect, hold and use your personal information to:

•       Respond to enquiries and communicate with you about our platform and services.

•       Onboard and manage relationships with estate developers and builders who use LotCheck.

•       Facilitate the operation of the platform, including matching floor plans to lots and generating buyer enquiries.

•       Share relevant details with estate developers or builders where necessary to progress an enquiry or project (see section 6).

•       Maintain records, improve our services, and conduct internal analytics and product development.

•       Send marketing or update communications where you have opted in, with the ability to opt out at any time.

•       Meet our legal and regulatory obligations.

5.  Automated Processing

The LotCheck platform uses rules-based logic to filter and display floor plans and lots based on inputs you provide, such as lot dimensions or preferred configurations. This processing is assistive — it helps present relevant options — and does not make binding decisions. You remain in control of any enquiry or next step you choose to take.

We will update this section as required when obligations relating to automated decision-making transparency take full effect under Australian privacy law.

6.  Disclosure of Your Information

We may disclose your personal information to:

•       Estate developers using the LotCheck platform in connection with a project you have enquired about.

•       Builders participating in the platform where relevant to your enquiry or floor plan interest.

•       Service providers that support our operations, including hosting, analytics, and communications platforms, who are engaged on confidentiality terms.

•       Professional advisers, insurers, or regulators where required by law.

We do not sell personal information to third parties.

Some of our service providers may store or process data outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with Australian privacy law.

7.  Storage and Security

We store personal information on secure systems and take reasonable technical and organisational steps to protect it from misuse, interference, loss, and unauthorised access or disclosure.

Indicative retention periods:                          

•       Enquiry and contact data: up to 2 years, or longer where required for ongoing business relationships.

•       Marketing opt-in records: until you withdraw consent.

•       Website and technical logs: up to 12 months.

When personal information is no longer required, we delete or de-identify it.

8.  Access and Correction

You may request access to personal information we hold about you, or ask us to correct information that is inaccurate, incomplete or out of date. Requests should be directed to mitch@lotcheck.com.au. We will respond within 30 days at no charge.

9.  Marketing Communications

We will only send you marketing communications if you have opted in. You can withdraw consent at any time by contacting us or using the unsubscribe option in any email we send.

10.  Complaints

If you believe we have not handled your personal information in accordance with this policy or the APPs, please contact us at mitch@lotcheck.com.au. We will acknowledge your complaint within 7 days and provide a written response within 30 days.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

11.  Notifiable Data Breaches

If a data breach occurs that is likely to result in serious harm to any individual whose information is affected, we will notify those individuals and the OAIC in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).

12.  Updates to This Policy

We may update this policy from time to time. The current version will always be available on our website with a revised effective date. For material changes we will provide additional notice where appropriate.
